March 23rd 2009 - PBS - Points Based System Tier 4 Student Visa

The UK Border Agency continues with the implementation of the TIER 1, 2 ,3 4 & 5 points based policy. The Point Based System - PBS - introduced by the UK in late February seeks to streamline the visa application process and make it more efficient. The Tier 4 student visa entry route is one area where the PBS is likely to have a big impact and will change the student market to more genuine applicants'.

Before the introduction of the PBS system, UK student visas were filled with various interpretations and fostered a number of dishonest practices. These loopholes exposed the system to abuse.

The introduction of the PBS places more responsibility in the hands of educational institutes and providers. The educational institutes work hand in hand with the UK Border Agency and the Accreditation bodies to ensure students entering United Kingdom meet PBS Tier 4 requirements and adhere to the rules. This includes reporting responsibilities.

The rules include the provision of a certificate of sponsorship to all students coming to the UK issued by the Education Provider. The certificates are issued by the educational institution which students will be joining. PBS and Tier 4 rules require the educational institute issuing the certificate of sponsorship to take various responsibilities for each student.

The tier 4 student visa takes into consideration the time required to complete the course and for graduation after successfully completing the course.

A student with a tier 4 visa can change courses within the same education institute without submitting another application. However should the student wish to transfer from the sponsoring institution - change the sponsor - it will require a new application. If a student wants to extend their visa then a further application will need to be made.

Under the PBS, tier 4 student visa holders cannot apply for permanent residency and are only allowed to work part time during studies. Some students will qualify to apply under Post Study Work visa category which allows you to carry on and work in the UK.
